Terms of Service

askMarshal is an artificial intelligence software tool designed to assist legal professionals in synthesizing and searching documents. askMarshal is not a law firm, does not engage in the practice of law, and does not provide formal legal advice. Licensed attorneys retain sole responsibility for independently verifying citations, factual accuracy, and compliance with court rules prior to filing or advising clients.
1. Acceptance of Terms & Entity Authority
By creating an account, accessing, or subscribing to the askMarshal platform, you ("Customer", "User", or "Subscriber") agree to be bound by these Master Terms of Service ("Terms") and our Privacy Policy. If you accept these Terms on behalf of a law firm, corporation, or partnership, you represent and warrant that you possess full legal authority to bind that entity.
The platform is operated by askMarshal Technologies Inc., located at 506 Santa Monica Blvd., Santa Monica, CA 90401.
2. Scope of Service & Attorney Professional Responsibility
askMarshal provides cloud-based document analysis, optical character recognition (OCR), deposition cross-examination indexing, and automated timeline generation.
3. Customer Ownership & Intellectual Property
Customer retains exclusive, sole ownership of all uploaded files, work product, notes, chronologies, and search outputs ("Customer Content"). askMarshal claims no ownership interest, title, or patent right in Customer Content. Customer grants askMarshal a limited, non-exclusive license solely to process and display Customer Content as necessary to deliver the service.
4. Confidentiality & Zero Model Training
askMarshal agrees to maintain strict confidentiality of all Customer Content. We covenant that Customer Content, queries, and synthesized outputs will never be disclosed to third parties (except as required by valid judicial order) and will never be used for artificial intelligence model training or benchmark evaluations.
5. Subscriptions, Payment & Cancellation
Subscriptions are billed in advance on a recurring monthly or annual basis depending on your selected tier (Solo Practitioner, Growth Firm, or Enterprise Firm). You may cancel your subscription at any time via your account settings. Upon cancellation, your workspace data will remain accessible through the end of your prepaid billing period, followed by a 30-day export window prior to permanent deletion.
6. Availability & Service Level Commitment
We target a 99.9% application uptime. Enterprise plans include customized Service Level Agreements (SLAs) specifying response times for emergency technical support. Scheduled maintenance windows are communicated in advance.
7. Limitation of Liability & Indemnification
To the maximum extent permitted by law, askMarshal Technologies Inc. shall not be liable for indirect, incidental, consequential, or punitive damages arising out of software usage. In no event shall askMarshal’s aggregate liability exceed the total fees paid by Customer to askMarshal in the twelve (12) months preceding the claim.
8. Governing Law & Venue
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
